On May 16, the sentence of 39 years 5 months and 10 days in the case of Semdinli against the mafia NCOs Ali Kaya and Özcan İldeniz and Veysel Ateş, member of JITEM , was cancelled by the 9th division for criminal matters of the appeal court as it declared that "the inquiries for incomplete".
The decision also included that "these people who struggle against terorism will not be dealt with as members of illegal organisations" and the case was handed over to the military court. By that, an example trial was held for the mebers of the counter guerilla who will be charged ans then released by a military court. This also shows that the counter guerilla is inviolable.
On November 9 2005, JITEM (the army's secret service), also member of the counter guerilla, a book shop in Semdinli, a small city in Northern Kurdistan. One Kurd died and two were wounded. However, the people of Semdinli caught the JITEM murderers due to their great determination and courage and handed them over to the state together with the weapons, the plans of the attack and the blacklist. The prevocational attacks in Semdinli exploded in the fists of the murderers through the common sense and determination of the Kurdish people. The counter guerrilla, in an uncomfortable position, opened the fire on the public prosecutor defending the state, the deputy Esat Canan, who was there at that moment, and the people. The trial starting shortly after that has shown once again that the fascist dictatorship does not accept any law. The defendants were also defended by the chief of general staff Büyükanit who said: "I have known them. They are good boys". Ferhat Sarikaya, public prosecutor of Van, who dealt with this trial, mentioned Büyükanit in his indictment and was therefore suspended. The district attorney who had accepted this accusation was told to move to another city. Tanju Cavus , a specialist and NCO, who opened the fire on the mass was released at the first trial. As the murderers were not touched, Seferi Yilmaz, the owner of the bookshop bombed in Semdinli, was detained for 11 months.
