Unethical violence and tyranny against the people are the truth of the state The indictment does not only hide the fact that the capitalist system, bourgeois state and fascist dictatorship of the National Security Council ( MGK )[*1], whose defence is assumed by the indictment itself, are characterised by applying terror in a systematic way, but it also tries to hide the fact that our party makes sometimes use of means of violence in the political struggle due to this political-social situation that conditions this use of violence. However, hiding the truth is like throwing mud at sun without being able to hinder it from shining. We are asking: Who killed the 15 comrades, among them the founding leaders of the Communist Party of Turkey (TKP) Mustafa Suphi and Ethem Nejat, at the Black Sea?[6] Is there any other reason but their ideas, for killing these communist cadres, who were on the way to Anatolia in order to strengthen the resistance of our people against imperialism and to unite it with the social liberation? Does this brutish and unethical violence not belong to the political representatives of the bourgeoisie? Because of the fact that the promise on autonomy[*2], that was given to them before the united anti-colonialist war carried out against the occupying British, French and Italian imperialists and the royalist Greek army that was attached to them, was denied after the victory by the new Turkish ruling classes and the oath of brotherhood was betrayed, our Kurdish people started a cry for freedom, from Kocgiri rebellion[7] to the uprising of Sheikh Sait[8], from the Agri revolt[9] to the Dersim rebellion[10]. Was it not the state of the Turkish bourgeoisie and the big landowners that became involved to strangle these with mass massacres, through gibbets and exile? Is it not the state of the Turkish bourgeoisie that has applied a racist and unethical violence in order to make the Kurds deny themselves and their rights by saying to our Kurdish people: "Actually your identity, your language, your culture and your history that consists of ages in Kurdistan, everything, everything is a lie; you changed after 1071[3*], you were started to be called "Kurds" because of the noise "kard-kurd"[4*] that comes out when walking in the snow, you are originally and thoroughly Turkish having migrated from the Middle Asia, you have to learn it and speak it out like that"? Were it not the bourgeoisie and the state that set up torture centres symbolised in the Sansaryan Han[11], tortured the men and women of this land who are full of love to the people, tried to leave them languish in prison, sent them to exile, in order to silence those who fight for the working class and the oppressed, break their will and hinder them from organizing themselves? Is it not the bourgeois state that organised a provocation and attack of "special war"[5*] on people of Greek minority and Armenian nationality on September 6-7[12], and that led the plunder of the real estates and valuable articles of those who were forced to immigrate because of fear? Were it not the official militarist forces and the anti-communist civil apparatus of the bourgeois state that attacked the working class' struggle, which had been increasing since the middle of the 1960s and culminating with the workers' revolt on June 15-16, 1970?[13] Were it not again these forces that attacked the land occupations by the poor and landless peasants as well as actions for autonomous-democratic university and anti-imperialist actions by the youth? Were it not them who shed the blood of the workers, peasants and the youth? Is it not the high military bureaucracy of the state that realised a fascist coup on March 12[6*] under the protection and with the will of the USA in order to crush and repress the rising political and social struggle, that removed the partial constitutional and legal democratic rights of the workers and the oppressed by force of arms, and that institutionalised a regime governed by the MGK (National Security Council) with the generals' Constitution called "Political Document of National Security"?[7*] Did the bourgeois ruling forces not support this with all its power? Were it not the collaborator bourgeoisie and its semi-military fascist regime that whirls wheels of torture everywhere from Istanbul to Diyarbakir, with a very symbolic one in Ziverbey Kosku?[14] Were it not them who killed the brave revolutionary sons of our peoples at the streets of Istanbul, at Nurhak, Kizildere , at the streets of Ankara, at gibbets, at the Mirik Hamlet and at the torture centres of Diyarbakir? Were it not them who applied the brutish and unethical violence which annihilated Mahir, Deniz, Ibo and their friends who fought in the front ranks with their mind, heart, will and body in order to break the yoke of the US imperialism and overthrow the fusty regime of the collaborating exploiters? [15] Was it anyone else than the collaborating capitalist state, its counter-guerrilla and its civil fascist apparatus that shed the blood of thousands of our people from the working class, youth, labouring public employees, peasants, intellectuals, artists and people from various professions during the period of 1974-1980 in order to stop the oppressed people's fast growing struggle and the strong revolutionary uprising? Were it not them who realised the most brutal slaughters, from Mayday 1977 to Maras , from the 1 Mayis neihbourhood to Beyazit Square, from Bahcelievler to Balgat? [16] Has it not been the fascist regime that continued using torture systematically throughout this period? Let us remember some of the results of the fascist coup of September 12[8*] that was organised in order to repress and destroy the revolutionary struggle of the broad masses of the working class and the oppressed, to be a better guard protecting the profits of US imperialism which had been expulsed from Iran together with its allies at that period and to apply the IMF program that was called at that time "the decisions of January 24"[9*] aiming at sentencing our people and first of all the working class to life in bigger poverty, under the worst living and working conditions, and in contrary to this, growing the wealth of the bourgeoisie and imperialists: 650,000 arrests, 10,000s of workers, students, peasants, women, men tortured, 300 of them killed through torture, extra-judicial killings on the streets and at surrounded houses, 100s of verdicts returned for execution and setting up 50 gibbets, 289 people killed in prisons that were turned into torture centres, 14 revolutionaries and Kurdish-patriots that had no other way but to sacrifice their life in deaths fasts in order to stop barbarity, 230,000 people taken to court with different claims, 30,000 workers, 3,854 teachers, 120 university professors and 47 judges were dismissed and expelled from their profession for the reason of not being reliable, 100s of army officers, petty officers and students of military college dismissed and expelled from universities because of their revolutionary and Kurdish-patriotic thoughts, 14,000 people having taken away their citizenship, 30,000 people made political refugees, 1.638,000 people being indexed by the police, 39 tons of newspapers and magazines annihilated, 10,000s of books confiscated, 937 films forbidden for reasons of being unreliable, unions, cooperatives, associations of women, youth, workers, peasants, intellectuals and artists as well as progressive parties closed and their leaders imprisoned... Is it not the state openly governed by the generals of the capital's army that is the owner and the executor of this uncontrolled fascist terror, some examples of which have been reflected above from different points of view? When the junta of fascist generals responsible for these brutal crimes against humanity announced "having seized the leadership", did the ringleaders of US imperialism in the Pentagon and White House not congratulate each other saying "our boys have done it"? Who else than the bourgeois state was it that realised new slaughters, atrocities, fascist tyranny and terror having an impact on millions of our people in the ‘90s, after having continued with every form of violence and killing in the ‘80s? Was it not the fascist state of the bourgeoisie that within a few years since February 1991 tortured 1000s of people, generalised its acts of killing under torture, extra-judicial killings, forced disappearances and torture by raping in the whole country, and killed 100s of revolutionaries and Kurdish-patriots with these methods?[10*] Was it not the denier colonialism[11*] that answered the national mass actions from Cizre to Lice[17] with mass massacres, set forests and villages on fire and forced 100,000s of Kurdish peasants to migration or condemning them to banishment? Who else than the fascist colonialist state, servant of the US imperialism, with its inhuman and racist policies, with the denial of the Kurds and their national rights, with the most brutal torture and repression in Kurdistan, and with the fascist bestiality in Diyarbakir prison which is the sum of all, made the armed Kurdish national movement inevitable? Is it not the one who carries out a dirty war due to which 10,000s of guerrillas, soldiers, officers of low-rank and civilians lost their life and who hunts head-and-ears[12*] in the name of repressing this most conscious and organised Kurdish revolt supported by millions of Kurdish peasants, workers and labourers? Were it not the army, JITEM [13*], MIT [14*] and the other state institutions that had organised, trained, armed and defended the counter-guerrilla apparatus called "Hezbollah" which is called "Hizbulkontra" by our people and which is known for its brutal crimes, torture and "grave-houses"?[15*] Who else than the "Special War Office"[16*] or the counter-guerrilla let popular artists and intellectuals burn alive in Sivas[18] by mobilising religious reactionaries in act similar to Bloody Sunday[19]? Were it not the state's counter-guerrilla and the official police forces who opened fire on the cafes in the Istanbul quarter Gazi [20] and killed one elderly Alevi, who organised a provocation by pushing our people into a reactionary polarisation and clash between Alevis and Sunnis in order to oppress all progressive revolutionary masses? Were they not the ones who even in front of the cameras committed mass massacres when their plans were crossed by the Alevi labourers who, standing up to ask account for the attack, did not go to the mosque but police station? Was it anyone else than the state's official and civil forces who organised a provocative and bloody attack on the mass gathering to join the rally in Kadikoy, Istanbul, on Mayday [21] and finally killed 3 revolutionary workers and labourers as a part of its 2nd wave of fascist total offence[17*] in order to hinder revolutionary and democratic awakening among the working class and the oppressed, to liquidate the accumulation of masses around the revolutionary movement and to hinder the increase in the level of the political struggle? Are the rubbish that came out at Susurluk[22], or the state's gangs that came up in the examples of Atabeyler, Sauna,[23] Semdinli [24] and Ergenekon [25] gangs anything else than some reflections on the x-ray of the fascist dictatorship? Was it not the state itself that brutally killed 28 revolutionary and Kurdish-patriotic prisoners in the prisons of Buca, Umraniye, Diyarbakir and Ulucanlar from autumn 1995 until autumn 1999, that made dozens of them face physical problems for the rest of their life and that with its deportation and isolation attacks within the same period made the death fast inevitable, where 12 of the revolutionary prisoners turned into martyrs and dozens of them became disabled?[26] Was it anyone else than the fascist regime that celebrated the 21st century with prison massacres, that attacked 20 prisons on December 19 , 2000 and killed 28 prisoners by grassfire, bullets or choking gas and that made it inevitable for 94 revolutionaries to sacrifice their life in a death fast as they did not have any other weapon against the F-type terror[18*] than their life, to put an end to the isolation which is a crime against humanity? Were it not the official forces of the denier-colonialist state that opened fire on the people of Diyarbakir[19*], who wanted to bury their sons and daughters that died in the national struggle, killed 4 children there and tortured 100s of children under arrest? Were it not them who shot 13 bullets at a 12-year old boy in Kiziltepe and killed him together with his father?[20*] Is it not the fascist dictatorship's official forces that want to hinder, scare, intimidate and silence the workers with means and methods of violence when they use their right of speech, action, gathering and organisation against the attacks and oppression on the students, unemployed, labouring public employees, women, oppressed nations and nationalities, people from the oppressed religious denominations, labouring peasants, small shopkeepers and handicraftsmen, against the privatisation terror, layoffs, the obstacles in front of unionisation, work-related accidents leading to death, low salary, bad working and living conditions, the ban on Mayday, the obstacles that make the right to strike unusable and retirement in the grave.[21*] Who else than the state is it that uses means and methods of violence in a systematic way such as truncheons, bats, gas bombs, pepper gas, pressurised water, plastic and real bullets, intimidation arrests against the labouring public employees who have taken the streets for the right of unionisation including the right to strike and collective agreement, wage increase, end of banishments[22*] and other kinds of repression or with the morality of solidarity with the oppressed and united struggle? Who else than the state does the same thing against the student youth who raises its voice by standing up against non-free education, the collaboration of police and administration at high schools, reactionary and chauvinist education that is based on learning by heart, OSS[27], YOK [28], the official militarist occupation in universities, the terror by the OGB[29], interrogations[30], the repression of being expelled from school and university fees; or by joining the united struggle for solidarity with the working class and the oppressed? Who else than the state applies the same methods against the poor of the cities who want a job and a human life and against the people of the labourers' neighbourhoods who stand up against the demolition of their houses and the intents of destroying their social solidarity? Who makes use of the mentioned methods of violence against the peasants who put forward their reaction and demands standing up against the high prices of agricultural inputs, the limitation of many products, mainly on tobacco, beetroot and tea, according to the demands of the IMF, the high charge of the agricultural credits, the destruction of the agriculture of labouring peasantry for the profit of the imperialist agricultural monopolies and the destruction of the environment by international mining monopolies? Who applies this violence on the working class and oppressed who are fighting for their rights and expressing their objections based on economic, social and political problems which we have described partially here and of which we could read a new one every day in the newspapers? How many men and women were killed while driving their car in the last year for not having obeyed the order to stop? How many people lost their lives at police stations when they supposedly "tried to get the policemen's weapon"? How many people were declared to have committed suicide at police stations as if they could not have found any other place? How many people have filed a complaint to human rights associations because of having faced torture and oppression? What kind of absurd and contemptible situation is it, that the indictment charges our party with "terrorism" in the name of such a system and political regime that has made violence against the working class and the oppressed become a part of everyday life for the profits of a bunch of collaborator big bosses, the armed and disarmed high bureaucracy that united its fate with them and the imperialists? *** 1* The National Security Council (MGK), composed of the Chief of General Staff and the four main Commanders of the Turkish Armed Forces (land, air, naval and gendarmerie forces), other high-ranking officials of the army, the President of the Republic, the Prime Minister and several ministers is the real governing force in Turkey and Northern Kurdistan. The MGK was founded and included in the constitution following the military coup in 1960. However, it became the absolute political power and the main institution that guarantees the continuity of the fascist regime only after the military coup in 1980, as its position and authorities were strengthened by the 1982 constitution following this coup. 2* Promise on autonomy - During the liberation war in Anatolia that resulted in the foundation of the Republic of Turkey, Mustafa Kemal Ataturk and his followers had promised autonomy to the Kurds in order to make an alliance with them against the imperialist forces that had occupied Anatolia. After the victory, this promise was denied and the Kurdish nation achieved no autonomy. Later on, even the existence of the Kurds was denied by the Turkish bourgeoisie led by Mustafa Kemal Ataturk. 3* 1071 - The nomadic Turks coming from the Middle Asia entered Anatolia after the Malazgirt War in 1071 between the Great Seljuq Empire and the Byzantine Empire. The Turkish state claims that the Kurds were originally a part of the nomadic Turks coming from the Middle Asia. 4* "kard-kurd" - According to the official thesis of the Turkish colonialist state, a part of the nomadic Turks coming from the Middle Asia inhabited the mountains at the eastern Anatolia (actually Northern Kurdistan). The mountains were snowy and while walking in the snow, a noise like "kard-kurd" comes out. The name "Kurd" comes from this noise and the Kurds are actually Turks according to this "thesis". 5* "Special war" refers to the Special War Office which is the official organisation that unofficially functions as the centre of the counter-guerrilla and coordinates the actions of the counter-guerrilla. "Attack of special war" means here an attack of the counter-guerrilla that used to happen in that period even when the Special War Office and the Office of Special Operations were not established yet. 6* In face of the serious increase in the mass movement and working class' struggle since the second half of the 1960s, the Turkish Armed Forces carried out a military coup on March 12, 1971, as a result of which many revolutionaries were killed, tortured and imprisoned. 7* Political Document of National Security is the main document of the Turkish state according to which the regime functions; in this sense, it is known as the real constitution of the Republic of Turkey. It is actualised every five year by the National Security Council. 8* The military coup of September 12, 1980 was carried out with the purpose of liquidating the revolutionary movement that had continuously increased during the 1970s. It was a part of the US-related military coups throughout the world, such as those in Chile, Argentine and other Latin American countries. With massive arrests, imprisonments and torture carried out, executions, imprisonments, forced disappearances, banning of the trade unions and democratic organisations, close-down of newspapers, this coup gave a heavy blow to the revolutionary organisations. 9* The decisions of January 24 - An economic program imposed by the IMF and approved by the government on January 24, 1980, which was the fundamental step for the neoliberal policies in Turkey and opened the gates to the foreign capital unilaterally. The program included 32.7 percent devaluation, subventions on agriculture were quite limited, daily quotation was announced and foreign trade was liberalised. 10* After 1989-1990, the armed struggle of the guerrillas of the PKK (Workers' Party of Kurdistan- the leading force of the Kurdish national struggle) deeply linked up with the people. In face of this fact, the state decided to wage a general war on the Kurdish people. This concept of dirty war started to be implemented in 1991. 11* Denier colonialism is a term used to explain the "denial and annihilation policy" of the Turkish colonialism that absolutely refuses the existence of the Kurdish nation and claims that the Kurds are in fact Turkish people living on the mountains. 12* "Head and ear hunters" refer to the Turkish army and counter-guerrilla forces who torture the dead bodies of the Kurdish guerrillas and collect the ears and other parts from the faces of those whom they kill. 13* JITEM (Gendarmerie Intelligence and Counterterrorism) is a dirty war organisation of the counter-guerrilla state. Its existence is officially denied by the state. It carried out many "murders by unknown assailants", torture, extrajudicial killings, kidnapping and forced disappearances; burnt down villages; organised bombing attacks for which the PKK would be blamed. 14* MIT (National Intelligence Organisation) is the governmental intelligence organization established in 1965. 15* Hizbulkontra (Hezbol-counter) is the name given to the Turkish Hezbollah, as this organisation was used by the state as a counter-guerrilla body against the PKK although it claimed to be fighting for an Islamic regime in the "South-Eastern part of Turkey" which is in fact Northern Kurdistan. Being completely separate from the original Hezbollah, it has been an active force of the dirty war in Kurdistan. After being used by the state for many years, the Hizbulkontra was liquidated by the state after fulfilling its mission. At the operations against it, 52 cadavers buried under the floor after being heavily tortured were found in different houses belonging to Hezbollah in seven cities. These houses were called "grave houses" 16* "Special War Office" and the "Office of Special Operations" are the two official organisations that unofficially function as the centre of the counter-guerrilla and coordinate the actions of the counter-guerrilla. 17* The first wave of such fascist total offence was the process that had begun in 1991 in the form of the dirty war in Kurdistan. 18* F type prisons are the isolation prisons imported from the EU. The F-type prisons came to agenda and began to be constructed in 1997 and were opened by the bloody massacre of December 19, 2000. These prisons consist of three-cell units which look like the letter F. 19* On March 24, 2006, 24 guerrillas of the PKK were killed by chemical weapons at the military operations in the province of Mus. Thousands of people joined their funerals. In the province of Diyarbakir, more than ten thousand people who joined the funeral of 4 guerrillas on March 28 were attacked by the police and the two-day lasting clashes started. 4 people, among them a 6-year child and a 12-year child, were killed; 250 people were injured and 200 were arrested. The arrested, among them also children, were heavily tortured. 20* In the Kiziltepe district of the province Mardin, two people were killed by the state on November 21, 2004. It was alleged that they were terrorists and had opened fire on the police. Later, it was understood that one of them was the 12-year-old child Ugur Kaymaz and the other was his father Ahmet Kaymaz, they had no guns and they were loading their truck for the work of the next day. The trial against the state's forces who committed this massacre still continues and has become a symbol of injustice. The democratic and revolutionary people who wanted to listen to the hearings were attacked by civil fascists several times. 21* Laws that increase the age of retirement are called laws of "retirement in grave"; as especially with the last changes, the age of retirement has increased to 65 from 58 for women and 60 for men. The average lifespan in Turkey is 66. 22* In order to stop the development of the public employees' struggle, the state often appoints the leading ones of this struggle to other cities. This method of the state is called "banishments".
