On December 24, 2009, the conscientious objector Enver Aydemir was detained in the middle of the street and sent to the military prison of Eskisehir, when he was on his way to the Conference of Conscientious Objection, organised at the Bosporus University of Istanbul. On January 21, 2010, Enver Aydemir, who was exposed to bad treatment and torture, was tried at the 1st Air Force Commandership located in Eskisehir by two different court boards.{divide} In the first hearing, only one judge was present but due to the 19/1 § of the law number 353 of the rules of the military court, such a trial has to be conducted by a board. Therefore, a lack of subject-matter jurisdiction was taken. Enver Aydemir, who objects the military service for reasons of religious belief, was tried for two different delicts by the military court. The first court board tried him accusing him of "insisting in refusal to obey orders partly or totally during the service", which is determined in 88 § in the military law. The military court board decided that he will stay in prison and postponed the process to April 22, 2010. At this hearing, witnesses will be heard. A second indictment was read out by another board in the same court room. This time, Aydemir was tried as a soldier for the delict of "not fulfilling the commands of the teachers during the lessons". The second trial ended with a decision of lack of subject-matter jurisdiction.
