The European Court of Human Rights (ECHR) decided that Abdullah Ocalan, the leader of PKK (Kurdistan Workers' Party) did not receive a fair trial and demanded a retrial for him. Ocalan was brought to State Security Court in 1999 and was sentenced to death on June 1999. The file is now being sent to the Ministerial Committee of the European Council. So the road for the retrial of the Kurdish political leader Ocalan had been opened. This was an expected situation. And again as expected, the ruling classes gave start to a chauvinist campaign of distortion.

It should be underlined that, both the ECHR as an organ of the EU that represents the unity of imperialist monopolies, the Turkish liberals and the Turkish generals with their political followers unite on the view that Ocalan is a "terrorist" and "criminal". All these powers try to brand the legitimate rebellion of the Kurdish nation and her right to defend herself with weapons as "terror". By stating that "Ocalan is evaluated as the leader of the most dangerous terrorist organisation in Turkey" ECHR also branded Kurdish national leader Ocalan as "terrorist" in its decision. ECHR, at the same time, branded the international complot of the American and European imperialists, who kidnapped Ocalan from Kenya and gave him to the hands of the Turkish state, as "suitable to the law" and tried to legitimize this act of piracy. Furthermore, the ECHR approved the inhuman isolation which Mr. Ocalan is subjected to in ImralA6 Island, with the excuse of "security".

The reasons for the decision of the ECHR was regarding issues of procedure, such as the long custody period, military judge appearance in the first hearings of the trial, and the violation of the right of defence of Ocalan.

Ocalan's imprisonment is a product of an international imperialist conspiracy

Abdullah Ocalan, leader of PKK and the Kurdish national movement, was kidnapped from Kenya on the 15th of February by the US imperialism with an act of international piracy and was hand over to Turkey, where he was put into isolation in the specially-organised ImralA6 prison.

The colonialist fascist Turkish regime, the criminals of the great historical unjustness, tyranny, assimilation, denial and destruction, which the Kurdish nation had been subject to, tried to condemn the Kurdish nation who used her right to rebel against all these with the trial against Ocalan.

Naming Ocalan as the "Chief terrorist", "baby killer", "separatist gang chief", "murderer of 30 thousand people" etc, these concepts were made the obligatory language of the TV and newspapers. The regime suppressed even the smallest question mark in the minds of the Turkish labourers with ideological and political violence. The struggles of the Kurdish national movement and the Marxist Leninist Communists to establish a democratic barricade against these jingoist incitements was also responded with fascist state terror.

In the Imrali Court, the oppressed Kurdish people was tried

The trial of ImralA6 was organised to cover-up the crimes of the colonialist-fascist regime against the Kurdish nation. Just like the "Independence Courts" which hanged Sheikh Said in 1925, the State Security Court which gave the death penalty decision for Ocalan was a court of the oppressors, villains. In this court, the right of legitimate rebellion of a nation against the powers which hold it under yoke was judged. Ocalan was claimed responsible not only for the 10 thousand soldiers who were in fact sent to the mountains of Kurdistan to kill their brothers for the dirty interests of the ruling class, but also the 20 thousand Kurdish patriots who were the victims of the dirty war fascist regime waged. Now, after the decision of the ECHR, the defenders of the colonialist yoke over the Kurdish nation and Northern Kurdistan are in panic!

Because they are afraid that the trial will be a platform which will serve the further discussion of the Kurdish problem. They are afraid that the Ocalan trial, which they made a taboo for the people, will begin to be discussed. They are afraid if this taboo will collapse, the historical crimes committed by the Turkish colonial bourgeoisie against the Kurdish people will spread all over.

In the first phase of the Ocalan trial, the Turkish and Kurdish popular masses was driven out of the political scene by police brutality or was backed up by the Turkish bourgeois state with jingoist slogans. In this second phase we may witness the Turkish and Kurdish progressive masses taking the streets with the demands for an honoured, just and democratic peace and the banners of justice, equality and brotherhood.

Our call is for the People's Fraternalism

The demand "Freedom for Ocalan" means demanding the right of making politics for the Kurdish nation. The demand "Freedom for Ocalan" means to demand the judgement of the criminals of the dirty war (1984-1999) which was waged against the Kurdish nation. It is a call for making the state pay for the lives of the labourers who were put on soldier uniforms and were sent to war against the Kurdish people for the dirty interests of the Turkish bourgeoisie. It is a call for making the state pay for the villages burnt by the army in Kurdistan, for millions of peasants forced to immigration in this way, for the thousands of Kurdish women raped, for the tens of thousands people tortured and jailed just because they wanted the freedom of their homeland. It is a hand of unity and solidarity that wants to hold the Kurdish people those who wanted to be tried and imprisoned by the injustice courts of the regime on the personality of Ocalan.

The demand "Freedom for Ocalan" also means a call for the brotherhood of the Turkish and Kurdish peoples, in today's political atmosphere; in which we see millions of Kurds who go on the streets with the posters of Ocalan and millions of Turks who hate Ocalan with a consciousness incited by the ideological means of the ruling class.
